The paper deals with the question of the applicability, or not, of the notion of “implementation” to CJEU’s preliminary rulings on interpretation. The hypothesis put forward is that the answer can be affirmative, provided that the concept of implementation is understood in the broad sense and relativised to take into account the particular features of the preliminary ruling procedure (and, ultimately, of the EU’s legal order as a whole). The said working hypothesis is verified in the light of some considerations on the effects and the effectiveness of the rulings at issue, as well as the consequences that may arise in the event of non-compliance with such rulings.
