This article seeks to determine whether, under the provisions of the regulation establishing the European Public Prosecutor’s Office, a public prosecutor can be deemed competent to refer a preliminary ruling, in accordance with the concept of ‘jurisdiction’ as interpreted by the case law of the Court of Justice.
