In the light of Advocate General Spielmann’s Opinion in Case C-448/23, and pending a most likely finding of infringement by the Court of Justice, this contribution aims at assessing the role of Article 4(2) TEU in the solution of “identity conflicts” between the Member States and the Union, as well as to reflect on the relevant case law of the Polish Constitutional Court and on the limits of the Union’s current constitutional arrangements especially considering future enlargements.
