Direct Effect and the Crux (of What is Left) of the “Dual Preliminarity” Doctrine

After a brief introduction about the evolutionary nature of the principle of direct effect, the article submits ten arguments about the scope of this principle in the EU legal order. Then, the article shifts the study plan from a purely European to a national one, relating the direct effect to the doctrine of ‘dual preliminarity’ in Italy, today, emphasizing its strengths and weaknesses. Finally, a proposal is made grounded in an interpretation that intends to be as consistent as possible with the logic and aims of EU law, in particular direct effect.
