The commentary analyses the opinion of advocate general Richard de La Tour on the first two references for a preliminary ruling on the safe country of origin on which the Court of Justice will give its decision. The questions raised cover the scope of judicial review of the designation made in this regard by the national authorities and the possibility of classifying a country of origin as a safe country of origin by identifying categories of persons exposed to a risk of persecution or serious harm. The comment examines the solutions proposed by the advocate general also in the light of the provisions of the new Asylum Procedure Regulation.
