Abstract FRA | ENG | ITA

This Article offers a reflection, both theoretical and practical, on the principle of consistent interpretation of national law to EU law. After tracing its origins, the article examines the scope and limits of consistent interpretation in light of the development of the Court of Justice’s case-law, which has emphasized its role as a central tool in the hands of the EU “ordinary” judge. Furthermore, the Article addresses the role of consistent interpretation in relation to the overall framework of the EU system of judicial protection.
