The article analyzes the evolution of the Italian Constitutional Court’s case-law from ruling No. 269/2017 to the most recent judgment No. 181/2024. The assumption underlying this contribution is that the tendency towards recentralization of the Constitutional Court does not fully take into account the need for ordinary courts, in their full discretion, to apply EU law in accordance with the instruments of the supranational legal system, such as disapplication, preliminary references procedure, and, significantly, consistent interpretation.
