This article analyses the role of the ordinary judge in the context of constitutional jurisprudence in light of judgment No. 181/2024. After framing the various rulings of the Constitutional Court that have defined the new model of the relationship between legal orders, this article reflects on the role of the judge at the crossroads of judicial remedies, focusing in particular on the relationship between preliminary reference procedure and the referral to the Constitutional Court. In this analysis, the consistent interpretation that allows the judge to apply domestic law in accordance with EU law plays a key role.
