This contribution aims to address the issue of the recent constitutional case-law overturning the Granital ruling (No. 170/1984). In particular, this development is analysed through the “lens” of the criminal judge of first instance, which highlights certain critical issues in the interaction between domestic criminal law and EU law that can be mitigated thanks to the contribution of both the ordinary courts and the Constitutional Court itself in dialogue with the EU Court of Justice.
